Tapes in missing NY boy case expected in court

I believe that the video "confession" should not be admissible in court. The article states that Hernandez has a "very low IQ", meaning it would be easy to convince him to admit a crime he did not do. It is possible that this man could still be guilty of the crime, but he still has the right to a fair trial and due process, and the verdict should not be determined based on a video that very well could have been a statement that he was encouraged to say, even if it was false. What do you think? Should the video be valid evidence in court? Do you think he was encouraged to provide a confession in 2012?

  1. The fact that Hernandez confessed to 15 people in a church, and not one of the members contacted the authorities, makes me think what he is saying is not all true. However, in my opinion what he is confessing sounds realistic and not thought out as a lie. Hernandez most likely killed the boy.

  2. In my opinion I believe that the confession video should not be valid in court. With the lack of information confessed by Hernandez, it reveals how unreliable his story is if he only remembers "that Etan had a cap on when he vanished" and "he tossed the boy's book bag behind a freezer" (although the bag was never found). However since this confession did come straight from Hernandez, we don't know if it is fully true. I agree with Elyse about it would being easy to convince Hernandez to confess a crime he didn't do. Also his medical history could have a possible affect. I'm not saying he isn't guilty but that the video should not be used in court.

  3. It sounds like he was tired from all of the questioning and just wanted to get the confession over with, whether he did it or not. Like someone else said, the details of his story seem unreliable and he would probably remember more if he had killed the boy. The video should not be used in court and more evidence should be found before they make a decision.

  4. I believe that the video should not be effective in the verdict of the trial. From the information the article displays, the video confession seems to be invalid and not trustworthy. We can also come to the conclusion that the video in not trustworthy due to the fact that Hernandez is claimed to be bipolar, which leads to the idea that maybe he was not in the right state of mind while recording the video? All of his details seem unreliable, which is why it should not be used in court. I also agree with Vivian when she states that his story is unreliable due to the lack of details he uses on video. To add on to that, I think that if someone were to commit such a heinous crime, that he/she would remember the details of the event.

  5. I believe that the video should not be used in the trial. One thing we do know is that he is guilty of killing a child, even if he does not remember why he did it. His disorder of being bipolar makes me believe that the video could not be helpful but also could. At the end we do not know whether the confession is legit or not. Maybe there is also another disease Hernandez did not inform officials of. It does not matter if he remembers the details or why he came to killing an innocent child all we know is that even though he is pleading guilty, he will most likely be accused guilty.

    1. Robert, I agree with that last statement about him being found guilty either way. At least, he will never be able to start with a fresh slate. If that confession was provoked then the interrogators have now ruined this man's life. It is sad that a world can be so unforgiving to a man who potentially has a mental disability and hasn't even had a trial yet.

  7. I agree with everyone else when they say that the confessions tape should not be admissible in court. This man sounds really crazy and I'm not sure if we can trust what he says. He has told the court that he choked and killed this little boy, but some of the facts do not match what the police have found. I am not sure what Hernandez did, and I do not know if anything he said was true. I do not think that this video would play a huge part of determining what happened. Like Elyse said it could have been a fake confession to lessen his sentence, but how reliable is this video?
